THE USER ACKNOWLEDGES THAT ANY BROWSING ON THE PEYI.ME PLATFORM OR WEBSITE, EVEN WITHOUT USING ITS SERVICES, CONSTITUTES UNCONDITIONAL ACCEPTANCE OF THIS PRIVACY POLICY.

ARTICLE 1 - GENERALITIES

This privacy policy (hereinafter the "Privacy Policy") applies to personal data (hereinafter "Personal Data") processed by Ludotech Holding, a limited liability company with a share capital of €3,000, whose registered office is located in LYON (69003) - 21 rue ddanton, registered with the Lyon Trade and Companies Register under number 831 217 872, (hereinafter "PEYI.ME") in connection with any relationship with its prospects, clients, and users (hereinafter collectively referred to as "Users") of the "PEYI.ME" Platform and through the operation of the Platform (hereinafter referred to as the "Platform") by any individual with a subscription or access to the Platform.


The purpose of this Privacy Policy is to implement PEYI.ME's obligations under Law No. 78-17 of January 6, 1978, on data processing, data files, and individual liberties (Data Protection Law) and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) (hereinafter collectively referred to as the "Regulation") and any binding text relating to this Regulation.


The Privacy Policy describes: (i) the types of Personal Data that PEYI.ME processes, (ii) their use and disclosure to third parties, (iii) the User's choices regarding the various processing operations carried out based on their Personal Data. The term "Personal Data" refers to information that directly or indirectly identifies a User, natural person, such as their name, email address, phone number, etc., but does not include purely professional data of any partner registering on the Platform, such as the registered office of their company, commercial designation, etc. To comply with the Regulation, PEYI.ME has implemented technical and organizational measures aimed at ensuring the highest level of security and confidentiality of the Personal Data of Users of the Platform, whether they are Clients or Professional Partners.


ARTICLE 2 - SCOPE

This Privacy Policy applies to the processing of Personal Data by PEYI.ME from the following sources:

  • Users of the Platform, whether individuals (Clients) or professionals (Partners);

  • Participants in specific events organized by PEYI.ME, such as training sessions on the use of the Platform;

  • Clients and prospects of PEYI.ME and their representatives, natural persons;

  • Suppliers and business partners and their representatives, natural persons.


ARTICLE 3 – DATA CONTROLLER AND CONTACT

ARTICLE 4 – NATURE OF PROCESSED PERSONAL DATA

PEYI.ME may process Users' Personal Data collected both:

  • offline: direct interaction between PEYI.ME teams and a User, natural person, participation in an event, training, etc.

  • online: use of the Platform, activity on the website or application, email or phone exchanges, etc.


The Personal Data that PEYI.ME may collect and process from any User includes the following:

  • name, first name, title, physical address, email addresses, and phone numbers;

  • individual identifiers and passwords;

  • professional role;

  • IP address and derived information from the IP address, including geographic location;

  • any information about a device used, such as browser, device type, operating system, presence or use of third-party applications, screen resolution, and preferred language;

  • behavioral data from the computer or device connected to the Platform, such as content areas or date and time of activities.


It is reminded that PEYI.ME is not responsible for Personal Data published by Users on the Platform and its use by non-Platform Users.


ARTICLE 5 – PURPOSES OF PROCESSING PERSONAL DATA

PEYI.ME processes Users' Personal Data primarily for the proper performance of its contractual obligations, on the one hand, for the sale of subscriptions and for the normal and compliant use of its Platform under the terms of the general license agreement for the use of the Platform. Specifically, PEYI.ME processes Personal Data for the sole purposes defined below:

  • Enable access, interaction, operation, and corrective and evolutionary maintenance of the Platform and all its services and purposes: customer consumption, location of the restaurant establishment, classification and referencing of restaurants, generation of statistics, etc.

  • Manage orders placed with restaurants by their customers and payment through the Platform.

  • Perform any contractual obligation related to the subscription to the Platform (general license terms for the use of the Platform).

  • Execute feedback on the Platform (reviews, comments, availability, etc.) by Users, enabling Partner referencing.

  • Facilitate communication and interconnection of the Platform with any other User information system (networks, professional software, etc.).

  • Communicate and respond to questions and inquiries: contact form, email exchanges, etc.

  • Offer Platform functionalities and ensure its technical and functional management.

  • Enable Users to engage in communication and transactions on and off the Platform.

  • Manage the security of the Platform, networks, and computer systems used by PEYI.ME.

  • Manage records, invoicing, accounting, and more generally, the normal operation of accounting and financial relationships between Users and PEYI.ME.

  • Comply with the Regulation, and more generally, with all other applicable laws and regulations.

It is specified that PEYI.ME does not process the customer's restaurant payment information, as it is handled by the payment partner "Stripe," which has its own rules for managing personal data. PEYI.ME encourages any User making a payment through the Platform to review this payment partner's privacy policy.


ARTICLE 6 – LEGALITY OF PERSONAL DATA PROCESSING

PEYI.ME is legitimate to process Users' Personal Data without their express consent for the following reasons:

  • To fulfill all contractual obligations, including the general terms of use of the Platform and its general terms of use, only when the execution of these contracts requires the processing of Users' Personal Data and for the sole purposes of these contracts (subscription management, user accounts and profiles management, order management and payment, transactions and partner referencing, ensuring Platform features and maintenance, identifying Partner's business area or premises, etc.).

  • To conduct transactions with customers, suppliers, and business partners of PEYI.ME, and to process subscription to the Platform and associated services.

  • To comply with accounting requirements, invoicing, tax declarations, and any other regulation related to the normal and ongoing operation of a company.

  • To analyze, develop, improve, and optimize the Platform, ensure its security, as well as the security of PEYI.ME's networks and systems.

  • To comply with applicable laws and regulations, or any legal process, or for the exercise of Users' rights defined in Article 9 below.

  • To analyze the volume and history of the Platform and, more generally, to perform any statistics regarding the use of the Platform.

  • For conducting checks, audits, restructuring operations, or transfer of control or any similar legal operations, PEYI.ME ensuring that all Users' Personal Data is anonymized, and in case of impossibility, ensuring that any third party involved in these operations is subject to a professional or contractual obligation of confidentiality and deletion of data specifically related to Users' Personal Data.


ARTICLE 7 – SHARING OF PERSONAL DATA

PEYI.ME does not disclose Personal Data of customer Users of the restaurant, except with its payment partner and solely for that purpose. PEYI.ME may share the Personal Data of the restaurant Client under the following conditions:

  • Sharing within PEYI.ME: PEYI.ME employees and agents are authorized to access Personal Data only to the extent necessary for the performance of their duties.

  • Sharing with third parties: only PEYI.ME's third-party service providers strictly essential for the operation of the Platform (data hosting, online payment processing services, order processing services, event or advertising campaign management, Platform maintenance services, services performed for Users, audits, and other similar service providers) may have access to and process this Personal Data.

  • Third parties involved in the event of restructuring, merger, sale, creation of a joint venture, transfer, or any other transfer of all or part of PEYI.ME's activities, assets, or shares.

  • In accordance with the law, especially to comply with a subpoena or any other legal process, when disclosure is necessary to protect the rights of the User or PEYI.ME, protect the security of PEYI.ME, the User, or the safety of others, investigate any fraud, or respond to requests from public and governmental authorities.

When third parties have access to this Personal Data, PEYI.ME takes all appropriate contractual, technical, and organizational measures to ensure that these third parties strictly process the data necessary and in accordance with this Privacy Policy and the Regulation.


ARTICLE 8 – RETENTION PERIOD OF PERSONAL DATA

PEYI.ME may retain Personal Data for the following retention periods, in an intermediate archiving process:

  • Personal Data collected for transaction management with customers, suppliers, and business partners of PEYI.ME will be kept for the duration of the relevant contract and for the entire legal prescription period. Non-essential data for contract designation, financial, and accounting transactions may be automatically deleted within 18 months following the end of the contract, while other data will be partially retained.

  • Personal Data collected from any User will be kept as long as their account is considered active on the Platform, and then will be deleted if there has been no connection to the Platform for 18 consecutive months. However, Personal Data necessary for User identification, account creation and login dates, last activities on the Platform will be retained for the entire legal prescription period before being automatically deleted.

  • Personal Data of anyone subscribed to PEYI.ME's newsletters and similar communications will be kept until a request for unsubscribing from this mailing list is made, and these data will be deleted within 30 days of such request.

  • Personal Data of any prospect, such as name, first name, email address, or phone number collected online on the Platform when using the contact form or participating in an event, training, or presentation by PEYI.ME, used for direct marketing and sales activities, will be kept as long as PEYI.ME maintains an active relationship with this prospect. An active contact is considered (i) the prospect's interaction with PEYI.ME or updating contact details and preferences within the last 18 months; and (ii) if the prospect has not requested deletion.

ARTICLE 9 – USERS' RIGHTS AND CONCERNED INDIVIDUALS

In accordance with the aforementioned Regulation, any User or individual concerned by the processing of Personal Data by PEYI.ME has the rights of access, opposition, rectification, and deletion of their personal data. They can exercise this right, in compliance with the Regulation, by a simple request to the data controller or the Data Protection Officer (DPO) of PEYI.ME. They also have the right to object to automated processing, including geolocation, and the right to contact the CNIL (French Data Protection Authority).

ARTICLE 10 – COOKIES / TRACKING

Certain Personal Data is automatically collected through the User's actions on the Platform. PEYI.ME uses cookies and tracking technology to improve and personalize the Platform and/or measure its audience.

The cookies used by PEYI.ME have the purpose of enabling or facilitating communication, providing services requested by Users, personalizing advertisements based on User interests, ensuring the proper functioning of the Platform, and recognizing Users upon any connection to the Platform.

In accordance with the Regulation, PEYI.ME will require authorization before implementing any other type of cookies on a hard drive. The User has the option to accept or refuse all or part of non-functional and non-anonymized Cookies, in accordance with the CNIL deliberation n° 2020-092 of September 17, 2020.

While browsing third-party websites advertising on the PEYI.ME website, or possibly when viewing these advertisements, cookies may be created by the companies displaying these advertisements.

Third parties using cookies in the context of PEYI.ME services (partners or other third parties providing content or services available on the PEYI.ME Platform) are responsible for the cookies they set up, and their cookie policies apply.

PEYI.ME assumes no responsibility for the possible use of cookies by these third parties. For more details, it is advisable to consult the advertisers' or third parties' cookie use policies directly on their respective websites.

The User has the right to accept or refuse the installation of cookies on the device used to connect to the Platform, following the CNIL recommendation (guidelines of September 17, 2020).

ARTICLE 11 – SECURITY

In the scope of its services and Platform management, PEYI.ME attaches the utmost importance to the security and integrity of Personal Data.

Thus, and in accordance with the Regulation, PEYI.ME undertakes to take all necessary precautions to preserve the security of Personal Data, including protecting them against any accidental or unlawful destruction, accidental loss, alteration, dissemination or unauthorized access, as well as against any other unlawful form of processing or communication to unauthorized persons.

To adhere to this framework, PEYI.ME has implemented technical and organizational measures aimed at ensuring the highest level of security and confidentiality of Users' Personal Data.

Furthermore, to prevent unauthorized access, ensure accuracy, and proper use of Personal Data, PEYI.ME has implemented appropriate electronic, physical, and managerial procedures to safeguard and preserve the data collected through its services and the Platform.


ARTICLE 12 – ACCOUNT PASSWORDS

PEYI.ME has chosen to apply the recommendations of the CNIL regarding the level of password security that may be required. Passwords for User accounts must contain at least 8 characters, including one uppercase and one lowercase letter, one digit, and 1 special character.


ARTICLE 13 – PROCESSING OF DATA BETWEEN USERS

Any User who is a private customer accepts that their profile may be viewed by a restaurant User, primarily for the purpose of managing restaurant orders and payment.

PEYI.ME cannot be held responsible for compliance with regulations related to the processing of personal data by any professional User, even concerning personal data collected on the Platform.

The professional User undertakes to comply with regulations related to the processing of personal data regarding any personal data collected directly or indirectly through the Platform.

The professional User undertakes to delete all personal data collected directly or indirectly through the Platform concerning Users who have not contracted with them and any data they would not have collected without the Platform.


ARTICLE 14 – MODIFICATION OF THE PRIVACY POLICY

PEYI.ME reserves the right to evolve this Privacy Policy at any time, especially in accordance with changes to current laws and regulations. If these modifications concern the lawfulness and purposes of processing, the nature of the processed Personal Data, their retention period, the User will be informed during their navigation on the Platform and must, if necessary, give their consent. Otherwise, they must be able to continue using the Platform.
